PLEASE READ THESE TERMS CAREFULLY BEFORE USING MY SERVICES. BY USING MY SERVICES, YOU AGREE TO THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE MY SERVICES.
These Terms of Service ("Terms") govern your access to and use of the services, software, and products provided by FenceFaster ("FenceFaster," "I," "me," or "my"), including my instant quote generator, project visualizer, and CRM management system (collectively, the "Services"). By accessing or using my Services, you agree to be bound by these Terms and my Privacy Policy, which is incorporated by reference and available at https://fencefaster.io/privacy-policy.
1. Acceptance of Terms
By registering for, accessing, or using my Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and my Privacy Policy. These Terms constitute a legally binding agreement between you (either as an individual or on behalf of an entity) and FenceFaster.
If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms. In that case, "you" and "your" will refer to that entity.
2. Description of Services
FenceFaster provides technology solutions for fence company owners, including:
2.1 One-Time Products
- Instant Quote Generator: A custom-implemented tool that generates instant quotes for fence projects
- Project Visualizer: A custom-implemented tool that provides visual representations of fence projects
These products are sold as one-time purchases with custom implementation. Pricing is provided upon request.
2.2 Subscription Services
CRM Management System: A customer relationship management system provided on a subscription basis. Pricing is provided upon request.
3. Account Registration and Eligibility
3.1 Account Creation
To use my Services, you must:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Maintain the security of your account credentials
- Accept responsibility for all activities that occur under your account
- Notify me immediately of any unauthorized use of your account
3.2 Eligibility
My Services are intended for business use only. You must:
- Be at least 18 years of age
- Have the legal authority to enter into binding contracts
- Operate a legitimate business in the fence industry or related field
- Not be located in any jurisdiction where the Services are prohibited by law
4. Pricing and Payment
4.1 Pricing
One-Time Products: The instant quote generator and project visualizer are sold as one-time purchases. Pricing varies based on customization requirements and is provided upon request.
CRM Subscription: The CRM management system is available on a subscription basis. Pricing is provided upon request.
4.2 Payment Terms
- Payment is due prior to delivery or implementation of Services
- I accept various payment methods for transactions
- Subscription services automatically renew at the end of each billing period unless cancelled
- If payment fails, your access to subscription services may be suspended or terminated
4.3 No Refunds
All sales are final. I do not offer refunds for any Services, including:
- One-time product purchases (instant quote generator, project visualizer)
- Subscription fees (CRM management system)
- Setup, implementation, or customization fees
Due to the custom nature of my implementations and the immediate value delivered, no refunds will be issued once payment is processed.
5. License and Intellectual Property Rights
5.1 License Grant
Subject to your compliance with these Terms and payment of all applicable fees, I grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services solely for your internal business purposes.
5.2 Ownership
FenceFaster retains all rights, title, and interest in and to the Services, including:
- All software, code, algorithms, and technology
- All designs, graphics, user interfaces, and visual elements
- All trademarks, service marks, logos, and brand elements
- All improvements, modifications, and derivative works
- All intellectual property rights
Nothing in these Terms transfers any ownership rights to you.
6. Acceptable Use Policy
6.1 Permitted Use
You agree to use the Services only for lawful business purposes and in accordance with these Terms.
6.2 Prohibited Activities
You agree NOT to:
- Resell, sublicense, rent, lease, or otherwise transfer access to the Services
- Reverse engineer, decompile, or disassemble the Services
- Attempt to gain unauthorized access to the Services or my systems
- Share your account login credentials with any other person
- Use the Services for any illegal, fraudulent, or unauthorized purpose
- Transmit viruses, malware, or other malicious code
- Use the Services to develop or offer competing products
7. Warranties and Disclaimers
7.1 Disclaimer of Warranties
THE SERVICES ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
To the maximum extent permitted by law, I disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, or completeness.
7.2 No Guarantee of Results
I do not warrant or guarantee that:
- The Services will meet your specific requirements or expectations
- The Services will be error-free or operate without interruption
- Any errors or defects will be corrected
- Use of the Services will result in any particular business outcome or revenue
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MY TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.
IN NO EVENT SHALL I BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING:
- Lost profits, revenue, or business opportunities
- Loss of data or information
- Business interruption
- Cost of substitute services
9. Term, Termination, and Suspension
9.1 Cancellation by You
You may cancel your CRM subscription by:
- Sending an email to info@fencefaster.io
- Calling my support line at 1-813-518-8130 during business hours (Monday-Friday, 9:00 AM - 5:00 PM Eastern Time)
Cancellations are effective at the end of your current billing cycle. You will not receive a refund for any unused portion of your subscription.
9.2 Effect of Termination
Upon termination or cancellation:
- Your right to access and use the Services immediately ceases
- You remain responsible for all fees incurred prior to termination
- I will retain Your Data for 30 days, after which it may be permanently deleted
- You may request an export of Your Data within the 30-day retention period
10. SMS/Text Messaging Terms ("FenceFaster Notifications")
10.1 Program Description
When you opt in to receive text messages from FenceFaster by checking the consent box on my digital lead form, you will receive messages from the phone number: 1-813-518-8130
Messages are delivered through GoHighLevel's Lead Connector platform.
After you opt in, you may receive messages related to your account and services, including:
- Introduction messages when you submit a form
- Follow-up messages if you don't respond
- Scheduling updates and reminders
- Review requests after completed jobs
- Occasional promotional offers (if you've separately opted in to marketing messages)
10.2 Types of Messages
I send two types of text messages:
Transactional Messages: Introduction messages when you fill out my digital lead form, follow-up messages if you don't respond, scheduling updates and reminders, review requests after completed jobs, and other service-related communications.
Marketing Messages: Promotional offers, special deals, seasonal opportunities, and other marketing communications. Marketing messages require separate opt-in consent and are sent primarily to leads who have submitted forms but have not yet become customers (approximately 1-3 marketing messages per month).
10.3 Message Frequency
You can expect to receive approximately 3-5 text messages per month. Actual frequency may vary based on your account activity and service usage.
10.4 How to Opt-Out (Cancel)
You can cancel the SMS service at any time by:
- Texting "STOP", "UNSUBSCRIBE", "CANCEL", "END", or "QUIT" to 1-813-518-8130
- Contacting me at info@fencefaster.io or 1-813-518-8130
Upon sending "STOP," you will receive the following confirmation message:
"You have been unsubscribed from FenceFaster notifications. You will no longer receive SMS messages from us. Reply START to resubscribe or call 1-813-518-8130."
After this confirmation, you will no longer receive SMS messages from me. To rejoin, sign up as you did initially and I will resume sending SMS messages to you.
Note: Opting out of marketing messages does not affect transactional messages related to services you've requested.
10.5 Help and Support
If you experience issues with the messaging program, reply with the keyword "HELP" to 1-813-518-8130 and you will receive the following message:
"FenceFaster: Need help? Call us at 1-813-518-8130 or email info@fencefaster.io. For Terms: fencefaster.io/terms. Msg&data rates may apply."

10.6 Carrier Liability
Mobile carriers are not liable for delayed or undelivered messages.
10.7 Message and Data Rates
Message and data rates may apply for messages sent to you from me and to us from you. Message frequency varies. For questions about your text or data plan, contact your wireless provider.
10.8 Service Area
SMS services are available for United States phone numbers only. I do not send messages to international numbers.
10.9 Privacy
For privacy-related inquiries regarding my SMS program, please refer to my Privacy Policy at https://fencefaster.io/privacy-policy.
11. Dispute Resolution
11.1 Informal Resolution
Before initiating any formal dispute resolution, you agree to first contact me at info@fencefaster.io to attempt to resolve the dispute informally.
11.2 Binding Arbitration
If informal resolution fails, disputes will be resolved through binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association (AAA).
11.3 Class Action Waiver
YOU AND FENCEFASTER AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
11.4 Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict of law provisions.
